The ground rules.
These Terms & Conditions, including the liability waiver and release inside them, are the agreement you accept when you sign up for training with XPE Nashville LLC. Last updated July 7, 2026.
1. The Agreement
This agreement is between XPE Nashville LLC, a Tennessee limited liability company ("XPE Nashville," "we," "us"), and the person who accepts it during signup ("you"). The "Athlete" is the person receiving training. If the Athlete is 18 or older, you and the Athlete may be the same person. If the Athlete is under 18, you confirm that you are the Athlete's parent or legal guardian and that you accept this agreement for yourself and on the Athlete's behalf.
By checking the acceptance box and typing your name during signup, you sign this agreement electronically, and that signature has the same effect as a handwritten one. The Biometric Release is part of this agreement and is incorporated by reference.
2. Membership & Billing
Membership plans, pricing, and start dates are shown during signup. You authorize XPE Nashville to charge your saved payment method on a recurring basis for your selected plan until the membership is paused or canceled. Payments are processed by Stripe; we do not store full card numbers.
To pause or cancel a membership, email team@xpenashville.com. Pausing or canceling stops future charges — it does not refund amounts already paid or owed unless we agree otherwise or the law requires it.
3. Assumption of Risk
XPE Nashville training includes sprinting, SHREDmill and treadmill work, jumping, plyometrics, resistance and weight training, agility work, speed and performance testing, and related physical activities (the "Activities"). The Activities are inherently strenuous and carry real risk — including muscle and joint injuries, broken bones, concussion, heat-related illness, cardiac events, permanent disability, paralysis, and death — as well as risks from equipment, the facility itself, and contact with other athletes.
You understand these risks, and you voluntarily accept and assume all of them, both known and unknown, on your own behalf and on behalf of the Athlete. You confirm the Athlete is physically able to participate in the Activities and has no condition that would make participation unsafe, and you agree to tell us about any injury or health condition that could affect safe participation.
4. Release & Waiver of Liability
To the fullest extent permitted by Tennessee law, you release, waive, and discharge XPE Nashville LLC and its owners, members, managers, officers, employees, coaches, trainers, independent contractors, volunteers, and agents, along with the owners and landlord of the facility (together, the "Released Parties"), from any and all claims, demands, causes of action, and liability — including claims based on the ordinary negligence of a Released Party — for personal injury, illness, death, or property damage arising out of or related to the Athlete's presence at the facility or participation in the Activities.
This release does not apply to gross negligence, willful misconduct, or any liability that cannot be waived under applicable law.
5. Indemnification (Including Parents & Guardians)
You agree to defend, indemnify, and hold harmless the Released Parties from any claim, demand, or cause of action — including reasonable attorney's fees — brought by you, by the Athlete, or by anyone on the Athlete's behalf, arising out of the Athlete's presence at the facility or participation in the Activities, except to the extent caused by a Released Party's gross negligence or willful misconduct.
If you sign as a parent or guardian, you specifically agree that this indemnification covers claims brought by or on behalf of your minor child.
6. Medical Readiness & Emergency Authorization
XPE Nashville does not provide medical advice. We recommend the Athlete have a physician's clearance before beginning any training program. If the Athlete is injured or requires emergency care, you authorize XPE Nashville staff to obtain emergency medical treatment for the Athlete, and you agree that all costs of that treatment are your responsibility.
7. Facility Rules & Safety
The Athlete must follow staff and coach instructions and posted facility rules at all times. XPE Nashville may stop, modify, or restrict participation at any time when staff believes it is needed for safety, and may suspend or end a membership for conduct that endangers others, damages equipment, or disrupts training. Personal property brought to the facility is at your own risk.
8. Photo & Video
Training at XPE Nashville is regularly photographed and recorded. You grant XPE Nashville a perpetual, royalty-free license to use photos, video, and audio of the Athlete captured at the facility or at XPE Nashville events for coaching, records, and promotion — including on our website, social media, and marketing materials — without compensation or prior approval. Being on camera is a standard part of training at XPE Nashville, and published content will not be recalled.
9. Biometric Check-In
XPE Nashville uses facial recognition for athlete check-in and for logging training results to the correct athlete profile. This is covered in detail by the Biometric Release, which you accept as part of this agreement. In short: face data is used only inside XPE Nashville, is never sold or shared for advertising, and is permanently deleted 60 days after a membership is paused or canceled.
10. Disputes: Arbitration & Class-Action Waiver
Any dispute arising out of or relating to this agreement, the Activities, or the Athlete's presence at the facility will be resolved by binding arbitration on an individual basis in Wilson County, Tennessee, administered by the American Arbitration Association under its Consumer Arbitration Rules. Judgment on the arbitrator's award may be entered in any court with jurisdiction.
You and XPE Nashville each waive the right to a jury trial and the right to bring or participate in a class action. Either party may instead bring an individual claim in small claims court in Wilson County, Tennessee, if the claim qualifies.
11. Governing Law
This agreement is governed by the laws of the State of Tennessee, without regard to its conflict-of-law rules.
12. General Terms
- Duration. This agreement stays in effect while the Athlete trains at XPE Nashville, unless replaced by a newer signed agreement.
- Severability. If any part of this agreement is found unenforceable, the rest remains in full effect, and the unenforceable part is enforced to the maximum extent the law allows.
- Changes. We may update these Terms from time to time. Material changes will be posted on this page with a new "last updated" date, and continued training after a change means you accept it.
- Entire agreement. These Terms, the Biometric Release, and the signup details you selected are the entire agreement between you and XPE Nashville about training.
